Authorize the Chief Executive Officer to amend Woodward-APC’s contract for a Not-to-Exceed amount of $666,435.00 for the construction of revisions to the landscape and hardscape to accommodate Audubon Nature Institute design of Tricentennial Park and additional time and scope of work to be fully reimbursed by the Audubon Commission per terms of its existing CEA with RTA for requested improvements.

In January 2021 the Audubon Nature Institute (ANI) requested additional landscaping and aesthetic improvements to enhance the new Riverfront area between the terminal building and the landing dock, that connects the Audubon Aquarium to Spanish Plaza. RTA then executed a CEA with the Audubon Commission, the authorized public entity that manages ANI, in October 2022 to detail roles and responsibilities and reimbursement of costs related to RTA for these improvements.
On October 25, 2022, the RTA board approved amending RTA’s contract with Woodward-APC for Construction Services for the Canal St Ferry Terminal (CSFT) project to add $1,000,000 of landscaping, hardscaping and other aesthetic improvements to dry side and wet side of the project area.

DISCUSSION:
In the course of implementing improvements, ANI request additional scope approved by RTA and Woodward-APC. In addition, delays in reviewing and permitting for the work by the City of New Orleans resulted in additional cost overruns. As a result an additional $666,435.00 is required to complete the ANI request work. Both staff and ANI agreed to the additional costs. The Audubon Commission will pay for added expenses related to additional enhancement per the terms of the CEA, to be amended to reflect these changes. Woodward will continue to coordinate closely with RTA to ensure no delay in the construction schedule associated with these design changes. The requested change will not have any impact on the closeout of FTA funded portion of the project.
Staff recommends approving this request as it will further enhance the aesthetic value of the area and RTA’s recently completed ferry terminal with no net cost to RTA.
FINANCIAL IMPACT:
Woodward-APC will invoice monthly with detailed Time & Material breakdown per the existing contracted hourly rates in an amount Not-to-Exceed $666,435.00. The current value of the contract is $26,909,657.41, The approved amendment the total value will be $27,576,092.41. The RTA will submit invoices to ANI once received and ANI will pay the cost of the invoice to the agency, per the current process in place for previously approved ANI requested improvements. This will be a zero-dollar impact to the agency. For tracking purposes, this amendment will be charged to account number 1FERRY.1047.
NEXT STEPS:
Upon Board approval, staff will amend Woodward-APC’s contract to include the Tricentennial Park Redesign and additional time.
