AUTHORIZE the Chief Executive Officer to negotiate and amend the Cooperative Endeavor Agreement between RTA and Audubon Commission, to increase the limit of reimbursable costs from $1,226,374 to a not-to-exceed amount of $1,892,809.00.

In October 2022, the RTA and the Audubon Commission executed a Cooperative Endeavor Agreement (CEA) whereby the Audubon Commission would reimburse the RTA for all related design, construction and installation costs for additional landscaping and beautification enhancements to the Riverfront area in and around RTA’s Canal Street Ferry Terminal Project (CSFT). These requests were made by the Audubon Commission’s operator, the Audubon Nature Institute (ANI). The initial work was executed by RTA’s CSFT contractor, Woodward-APC.

DISCUSSION:

In the course of implementing improvements, additional costs were identified as a result of increased scope requests by ANI request additional scope approved by RTA and Woodward-APC. In addition, delays in reviewing and permitting the work resulted in additional cost overruns. As a result, Woodward-APC needs an additional $666,435.00 above its original $1,000,000 amount to complete the work requested by ANI. Both staff and ANI agreed to the additional costs. The Audubon Commission will pay for added expenses related to additional enhancement per the terms of the CEA; however the CEA needs to be amended to reflect the additional projects amount increasing to a total of $1,892,809.00 of reimbursable costs.

FINANCIAL IMPACT:

There is no financial impact to the amendment to this agreement. 

NEXT STEPS:

Upon Board approval, staff will negotiate and amend the CEA between RTA and Audubon Commission.
