Approval and ratification of amendment two (2) of the CEA between the Port of New Orleans and the RTA and authorization of payment for lease fees.

ISSUE/BACKGROUND:

The Port of New Orleans and the Regional Transit Authority has a CEA that allows the RTA to utilize a portion of the Port’s Canal Street Warf to construct and operate a temporary ferry landing. The temporary facility is required to allow continuous ferry operations during construction of the new Canal Street Ferry Terminal. Amendment two is needed due to delays in the construction schedule.

DISCUSSION:
The RTA has previously executed an agreement with the Port of New Orleans. To accommodate PONO approval deadlines, the RTA CEO signed a date extension amendment to that CEA, extending the duration from August 31, 2022, until June 30, 2023. The amended fee will cover ten (10) months of lease fees, there is a potential that only six months will be needed. The rates for the monthly fee were established in the original CEA.
FINANCIAL IMPACT:
The cost of the 10-month lease will be $137,914.10. The project is developing a strategy to reduce the duration to 6-month and a potential cost of $82,749. This amendment will be charged to account number 1FERRY.1047.
NEXT STEPS:
Upon Board approval, staff will amend the PO to Port of New Orleans.
